Part 1: The Picnic Teamwork App Terms of Use

Welcome to the Picnic Teamwork App! Through this app you can communicate with Picnic, see your working schedule, claim shifts, update your availability and many other things.

By using the Picnic Teamwork App, you agree with the following terms:

– You may only use the Picnic Teamwork App if you are directly or indirectly employed by Picnic, or through a temporary work or payroll agency.
– Picnic may block your access to the Picnic Teamwork App at any time
– By downloading the app, you obtain a non-exclusive, non-transferable and non-sublicensable right to use the app on your phone or tablet.
– You may not disassemble, decompile or reverse engineer the app.

Our app, website and services are protected by intellectual property rights. The rights to, for example, logos, software, texts and images belong to Picnic and/or to the person from whom we have obtained a licence. It is not allowed to disclose, duplicate and/or edit parts of our app, website or services without our explicit permission, other than for personal use.

What is also not permitted – hold on, we need to button this up – is: (a) to retrieve and reuse a substantial part of the content of the app and/or website and/or to repeatedly and systematically retrieve and reuse non-substantial parts of the content of the app and/or website; and/or (b) to use (or allow the use of) any software or hardware tools aimed at taking over, spidering, scrapping, searching or using in a similar manner not authorised by Picnic, information made accessible by Picnic.

Part 2: The Picnic Teamwork App Privacy Policy

If you use the Picnic Teamwork App, you want your data to be handled carefully and not to end up with just anyone. And rightly so. That’s why we take your privacy seriously.

It is also important to us that you understand what data we collect and what we do with it. We have therefore written down our privacy policy as clearly as possible.

1. When does this privacy policy apply?

This privacy policy applies when you use the Picnic Teamwork App as a Picnic employee, or if you are employed through a temporary work or payroll agency. 2. Who is responsible for your data?

Picnic Technologies B.V. is the Picnic company responsible for the processing of personal data as we describe in this privacy policy. Picnic Technologies B.V. may then also share the collected personal data with other Picnic companies, such as the Picnic company through which you are employed. For more information, please check the Picnic Employee Privacy Statement.

3. What data does Picnic collect?

When we talk about data or personal data in this privacy policy, we refer to all data that can be directly or indirectly traced back to you as an individual. When you use our app and website, we collect and use the following types of data:

Account data: this is the data you provide, or that is assigned to you when you are employed by Picnic:

  • Name
  • Email address
  • Password
  • Address
  • Phone number
  • Employee ID

Scheduling, availability and communications data: this is the information that you provide when using the features of the app, such as:

  • Your availability
  • Your preferred working hours
  • Your claimed shifts
  • Your assigned shifts
  • Your worked shifts
  • Absence information you provide
  • Communications you send or receive through the app

Technical device data: once you use the Picnic Teamwork App, the following technical information is stored:

  • Information on device type and operating system 
  • IP address
  • Device IDs
  • Type of network connection
  • Language preference
  • Screen size
  • Technical information on error messages and loading times

4. How does Picnic use your data?

In order to use your personal data, Picnic always needs a reason (a so-called legal basis). Picnic only uses your data for the following reasons:

Performance of a contract: some data we need to perform our contractual obligations as an employer. For example, we need your scheduling and availability data to plan and schedule shifts and to make sure you are paid your salary.

Legal obligation: sometimes a legal obligation requires us to collect and retain certain data. For example, tax and accounting laws require us to keep record of the hours you have worked and to keep track of any absence.

Legitimate interest:
in certain situations, Picnic or another party has a legitimate interest to process your data. For example, if you are employed by Picnic through a temporary work or payroll agency, Picnic has a legitimate interest to plan and schedule your shifts and availability

We will use your data for the following purposes:

To allow you to use the Picnic Teamwork App features

We use your personal data to make sure the Picnic Teamwork App runs smoothly and to allow you to use its features. Your personal data is used to allow you to submit your availability, claim and swap shifts with others and to make sure you can see your calendar with upcoming shifts. The Picnic Teamwork App is also used to inform you of new shift updates or new schedules becoming available.

We also use your personal data to make sure you can log in securely, using your Picnic login details. This also allows us to make sure the data you provide through the Picnic Teamwork App is properly stored in our employee database and in your employee file.

For this purpose, we use the following data:

  • Account data
  • Scheduling, availability and communications data
  • Technical device data

The legal basis for processing this data is:

  • Performance of a contract
  • Legal obligation

To plan our workforce

Based on the availability information that Picnic workers provide through the Picnic Teamwork App, Picnic plans its workforce. This helps Picnic run and optimise its fulfilment and distribution processes and to comply with contractual obligations, such as with respect to minimum or maximum working hours.

For this purpose, we use the following data:

  • Account data
  • Scheduling, availability and communications data

  • Performance of a contract
  • Legal obligation
  • Legitimate interest

To maintain and improve the Picnic Teamwork App

We try our best to maintain and improve the features of the Picnic Teamwork App constantly. For this purpose, we may look at information on how the Picnic Teamwork App is being used. For example, we look at how often certain features are used. We also look at potential issues and look at crash reports to fix technical problems that may occur. For these purposes, we may process your personal data.

For this purpose, we use the following data:

  • Account data
  • Scheduling, availability and communications data
  • Technical device data

The legal basis for processing this data is:

  • Legitimate interest

We will never use information on how you use the Picnic Teamwork App to evaluate your performance.

5. Does Picnic share your data with others?

Your personal data may only be shared with others as needed for the purposes mentioned above and in accordance with the Picnic Employee Privacy Statement. If you are employed through a temporary work agency or payroll service provider, your personal data may be shared with these parties to ensure your salary is being paid and to comply with contractual and legal obligations.

In addition, your personal data may be shared with the Picnic company where you perform your work. For example, if you work in Germany, your personal data may be shared with Picnic GmbH in accordance with the Picnic Employee Privacy Statement.

Your information will never be sold or shared with other third parties.

6. How long do we keep your data?

Picnic retains your data only for as long as this data is necessary for the purposes for which we collected it. The exact retention period therefore varies depending on the purpose for which the data was collected. As a main rule, we keep your data for as long as you are employed with us. In addition, there are various statutory retention periods that require Picnic to keep certain data longer than other data. Based on these statutory retention periods, we keep other data for up to 10 years after you are no longer employed with Picnic. 7. When can we use your data outside Europe and how do we protect it?

We try to process your data within Europe as much as possible. Sometimes it is necessary to use your data outside Europe, for example if a supplier is located outside Europe. When we use your data outside Europe, we ensure that this is done in accordance with this privacy policy and that the protection of your data is always adequately safeguarded. We do this, for example, by concluding agreements with suppliers based on the applicable European standard contractual clauses for the international transfer of personal data (you can ask customer service for a copy).

8. How do you secure my data?

Picnic takes organisational and technical measures to secure and protect your data as well as possible. For example, we use various security techniques (such as firewalls, encryption and virus scanners) to ensure that your personal data and the content of your communication is protected as well as possible. We use physical (access) security measures for our offices and important equipment (such as servers). We also keep our systems and software as up-to-date as possible and ensure that unauthorised persons cannot access your data by only allowing certain Picnic employees access to your data. There is also a separate department within Picnic that permanently focuses on the protection and security of your personal data, Picnic’s privacy policy and all privacy-related developments.

9. What rights do you have regarding your data?

You have the right to update, correct, access, delete, restrict the use of and to request portability of your personal data. For more information, please check out the Picnic Employee Privacy Statement.

We might need to change this privacy policy. If we make material changes, we will make sure to let you know.
